SWISS TEA FAMILY ADVENTURE SWEEPSTAKES

Official Rules of Play

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR
CHANCES OF WINNING.

1. ELIGIBILITY:  The Swiss Tea Family Adventure Sweepstakes (“Sweepstakes”) is open to all legal residents of the (50) United States and Washington, DC who are of the age of majority in their state of residence (age 18, except 19 in AL and NE, 21 in MS) as of May 15, 2009.  Employees, directors and officers, and their immediate families (spouses, parents, siblings, children and their respective spouses), and household members of Dean Foods Company (“Sponsor”), its affiliates, subsidiaries, distributors, retailers, promotion and advertising agencies, and any other company involved with the design, production or execution of the Sweepstakes are not eligible.  Online access and a valid email account are required to enter the Sweepstakes.  The Sweepstakes is subject to all applicable federal, state and local laws and regulations, and is void where prohibited by law.

2. HOW TO ENTER:  To enter, visit our website at www.swiss-tea.com (“Web site”) and follow the instructions posted (No PO Box addresses, please).  Sweepstakes starts on May 15, 2009 at 12:00:01 a.m. Central Time (“CT”) and ends on July 31, 2009 at 11:59:59 p.m. CT (“Promotion Period”).  Except in Florida and New York, where Sweepstakes starts on May 25, 2009 at 12:00:01 a.m. CT and ends on July 31, 2009 at 11:59:59 p.m. CT.  Limit one (1) entry per week, per person or address.  For the purpose of this Sweepstakes, a “week” begins on Friday at 12:00:01 a.m. CT and ends the following Thursday at 11:59:59 p.m. CT, except the final week of the Promotion Period which begins on Friday, July 24, 2009 at 12:00:01 a.m. CT and ends on the following Friday, July 31, 2009 at 11:59:59 p.m. CT.  Each entry will be deemed to have been submitted by the authorized account holder of the email account from which the entry originated.  Multiple participants are not permitted to share the same email address.  Any attempt by any participant to obtain more than one entry per week by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant will be disqualified.  The use of any automated system or third party entry method to participate is prohibited and will result in disqualification.  Administrator’s computer is the official time-keeping device for the Sweepstakes.

3. PRIZES/VALUES/ODDS:  One (1) Grand Prize: Family Adventure of Winner’s Choice.  Retail Value (“RV”) - $5,000.00.  One (1) First Prize: Weekend Getaway for Winner and Family, RV - $2,500.00.  One (1) Second Prize: Adventure Gear for Winner and Family, RV - $1,000.00.  One (1) Third Prize: Staycation Prize Package for Winner and Family, RV - $500.00.  All prizes are to be awarded in the form of Visa Gift Cards.  If any prize cannot be accepted in this form, prize will be forfeited in its entirety and awarded to an alternate winner.  Total RV for all Sweepstakes prizes is $9,000.00.  Odds of winning any prize depend upon the number of eligible Sweepstakes entries received.
4. SWEEPSTAKES DRAWINGS:  Potential prize winners will be selected via random drawings under the supervision of the Sweepstakes Administrator on or about August 5, 2009, and all potential winners will be notified by phone, mail or email within five (5) days of selection.  Limit one prize per person or address

5. GENERAL:  By participating, entrants acknowledge and agree to these Official Rules and the decisions of the Sponsor and Sweepstakes Administrator, whose decisions with regard to all aspects of the Sweepstakes shall be final and binding. All potential prize winners will be required to complete, notarize, sign and return an Affidavit of Eligibility & Liability/Publicity Release (where legal) as a condition of being named the official winner of a prize.  The Affidavit must be returned within ten (10) business days of first attempted notification. If documents are not returned timely, or the prize notification or the prize is returned as non-deliverable, or if a potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, the prize may be forfeited and awarded to an alternate winner.  Any tax liability is the sole responsibility of the winner.  All prizes are not exchangeable or transferable and cannot be redeemed for cash.  In the event of unavailability of stated prize, Sponsor reserves the right to substitute a prize of equal or greater value.  By accepting the prize, each winner consents (and agrees to confirm that consent in writing upon request) to Sponsor and those acting pursuant to the authority of Sponsor, the right, in perpetuity, to the use of winner’s name, voice, photo, picture, and likeness, at any time or times, in all media now known or hereafter discovered or devised, worldwide, including on the Internet and World Wide Web, for advertising, commercial, trade and promotional purposes, without additional compensation unless prohibited by law, and without notice, review or approval. Furthermore, each participant agrees that Sponsor, Sweepstakes Administrator,    their respective affiliates and agencies and all of there respective officers, directors, employees and representatives (individually and collectively “Releasees”) are released of any and all liabilities, and shall be indemnified and held harmless against any claims, injuries, losses or damages (whether due to negligence or otherwise) of any kind to persons, including death, or properties resulting directly or indirectly from acceptance, possession, use, or misuse of any prize, or participation in the Sweepstakes, or participation in any Sweepstakes related activity.   
In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an internet access provider, online service provider, internet service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

6. LIMITATIONS OF LIABILITY: 
Releasees are not responsible for lost, late, incomplete, stolen, misdirected, or illegible, entries, or email; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/Web site/use net accessibility, availability, or traffic congestion, or any technical error, or any program or programming error or failure, or unauthorized human intervention, or the incorrect or inaccurate capture of any information, or the failure to capture, or loss of, any information.  Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to, or use of, the Web site.  Releasees are not responsible for errors of any kind whether human, mechanical, electronic, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize, winners or in any Sweepstakes-related materials.  Releasees are not responsible for any liability or damage to any computer or system resulting from participation in, or accessing or downloading information in connection with this Sweepstakes.  Sponsor reserves the right, at its sole discretion, to cancel, terminate or suspend this Sweepstakes as of the time of such action should any computer virus, unauthorized human intervention or other causes, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes and award prizes from eligible entries received prior to the action taken or otherwise as determined by Sponsor.  The right is reserved by Sponsor in its sole discretion, to disqualify any individual found, at its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.  Any attempt by an individual to deliberately damage or tamper with the website or undermine the legitimate operation of the Sweepstakes is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual to the fullest extent permitted by law, including criminal prosecution; and disqualification for the Sweepstakes.

7. PRIVACY:  Information collected from entrant is subject to the Sponsor’s Privacy Policy at www.swiss-tea.com.  To read the Policy access that page and click on the Privacy Policy link.

8. DISPUTES:  Each participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Pennsylvania; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will a participant be permitted to obtain awards for, and each participant hereby waives all rights to claim punitive, incidental, or consequential damages, any other damages other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Pennsylvania or any other jurisdiction) that could cause the application of the laws of any jurisdiction other than the State of Pennsylvania.
